The 9th Court of First Instance of Bilbao has dismissed the lawsuit filed by Iberdrola against the chairman of ACS, Florentino Pérez, for interference in his honor during his role as a prosecutor in the case investigating the relationship between the electricity company and companies belonging to the ex-commissioner Villarejo.
In a sentence dated March 29th, to which EFE has had access, the magistrate emphasizes that ACS’s statements were not injurious since “he was not transmitting information, but rather assessments of undisputed facts” that affected Iberdrola, whose “unquestionable public projection” justifies “the legitimate fundamental right to freedom of expression”.
The judge recalls that this is the investigation of a “macro case” on the “alleged illicit works developed in relation to Iberdrola by the retired commissioner Villarejo”, and emphasizes that “it was known that a good part of those works referred to ACS and Florentino Pérez”.
